اگر پس از ارسال اظهارنامه، مستأجر همچنان از پرداخت اجور معوقه خودداری کند، موجر می‌تواند برای مطالبه حقوق خود، دادخواست مطالبه اجور معوقه را به دادگاه صالح ارائه دهد. در این مرحله، موارد زیر باید رعایت شود:

 تعیین صلاحیت دادگاه:

صلاحیت دادگاه برای رسیدگی به دعوی مطالبه اجور معوقه بر اساس مبلغ خواسته تعیین می‌شود:

• برای مبالغ تا یکصد میلیون تومان، دادگاه صلح محل اقامت مستأجر یا محل وقوع ملک صالح به رسیدگی است.
• برای مبالغ بیش از یکصد میلیون تومان، دادگاه عمومی حقوقی محل اقامت مستأجر صالح به رسیدگی خواهد بود.

تنظیم دادخواست مطالبه اجور معوقه:

دادخواست مطالبه اجور معوقه باید از طریق دفاتر خدمات الکترونیک قضایی به صورت آنلاین ثبت شود. اطلاعات زیر باید در دادخواست ذکر گردد:

• مشخصات موجر (خواهان): شامل نام، نام خانوادگی، آدرس، شماره ملی و دیگر اطلاعات هویتی.
• مشخصات مستأجر (خوانده): شامل نام، نام خانوادگی، آدرس و دیگر اطلاعات شناسایی.
• مبلغ دقیق اجور معوقه: مبلغ اجور معوقه به تفکیک هر دوره که پرداخت نشده است.
• شرح خواسته: بیان صریح خواسته موجر که شامل مطالبه اجور معوقه، خسارت تأخیر تأدیه (در صورت وجود) و دیگر حقوق قانونی است.
• درخواست‌های جانبی: در صورت لزوم، موجر می‌تواند درخواست‌های دیگری مانند تخلیه ملک (در صورت شرایط قانونی) یا مطالبه وجه التزام (در صورتی که در قرارداد ذکر شده باشد) را مطرح کند.

 ارائه مدارک برای دریافت بدهی‌ها:

هنگام تقدیم دادخواست، موجر باید تمامی مدارک مربوط به دعوی را به دادگاه ارائه کند. این مدارک شامل موارد زیر است:

• قرارداد اجاره: اصل یا رونوشت برابر اصل قرارداد اجاره.
• مدارک اثبات پرداخت‌های قبلی: رسیدهای پرداخت اجاره‌بها در صورت وجود.
• سند مالکیت ملک: جهت اثبات مالکیت موجر.
• کارت ملی موجر: جهت شناسایی صحیح خواهان.
• نسخه‌ای از اظهارنامه یا اخطارهای رسمی که به مستأجر ارسال شده است (در صورت وجود).

با انجام این مراحل، دادگاه پس از بررسی، تصمیمات لازم را برای رسیدگی به مطالبات موجر اتخاذ خواهد کرد.

پس از صدور حکم قطعی به نفع موجر، مراحل وصول اجور معوقه از طریق اجرای احکام دادگاه پیگیری می‌شود:

1. صدور اجراییه: موجر باید به واحد اجرای احکام دادگاه مراجعه کرده و تقاضای صدور اجراییه کند. اجراییه دستور دادگاه برای اجرای مفاد حکم است.
2. توقیف اموال مستأجر: پس از صدور اجراییه، موجر می‌تواند با معرفی اموال مستأجر (مانند حساب‌های بانکی، خودرو، یا ملک) به دادگاه، تقاضای توقیف آن‌ها را جهت وصول طلب خود کند.
